Good Evening Speakasians,
The AISPA writ was scheduled to be heard in the Bombay High Court today.
We saw that the three applications pending in the matter were listed in the cause list and as such we dint expect the main WRIT to be heard today and this was duly informed via a short update in the morning on facebook.
The applications that were listed for hearing today were as under:
1. APPW/322/2012: This is the criminal application filed by AISPA for SUO MOTU CONTEMPT being aggrieved by the false and mischievous reporting of the Bombay High Court hearing of 13th June, 2012 carried by TOI in the publication of 16th June, 2012. This Application was filed by AISPA on 19th June, 2012.
2. APPW/300/2012: This Application is filed by the EOW seeking to vacate the stay imposed on the investigation by the Hon’ble High Court on 21st March, 2012. This Application was filed by the EOW on 30th May, 2012.
3. APPW/118/2012: This Application was filed by AISPA for restoration of AISPA as a petitioner, immediately after the registration of the Association. This Application was filed by AISPA on 14th February, 2012.
Why was the main WRIT not listed along with the Applications?
If one cares to see the CASE STATUS of WP/3611, the matter shows as listed before the Divisional Bench of HON'BLE SHRI JUSTICE V.M. KANADE and HON'BLE SHRI JUSTICE P. D. KODE with the next date being 28th June, 2012.
Whereas all the applications which can be viewed under Appl. Cases section on the case status of 3611 correctly shows them to be listed before the Divisional Bench of HON'BLE SHRI JUSTICE A.M. KHANWILKAR and HON'BLE SHRI JUSTICE A. R. JOSHI with the hearing date as 3rd July, 2012.
Important to note here is the order of the Hon’ble Divisional Bench of 18th June, 2012: List the applications along with the Writ Petition on Tuesday, the 3rd July, 2012.
In my opinion this was simply an error and to our bad luck this has costed us about 15 days. But then nobody can be blamed for such procedural lacunas although we have to pay for the delay.
To even suggest that nobody tried to get this rectified is a faulty analysis and result of a sick mind whose main interest is to confuse the panelists.
